Terms of Service

These terms govern your use of maxxcommerce.com and any website, ecommerce store, SEO, social media, or support service ("Services") you order from MAXXCommerce ("we," "us," "our"). By submitting our questionnaire, paying a deposit, or engaging our Services, you agree to these terms.

Deposits & Payment

Every build starts with a 50% deposit to reserve your spot and begin work. The remaining balance is due once you've reviewed the finished site and are happy with it, before it goes live. Deposits are non-refundable once work has begun, except as described under Our Satisfaction Guarantee below.

Delivery Timelines

Most websites and stores are delivered in 7 business days (as little as 5 for priority packages) once we have your completed questionnaire and content. Timelines begin when we receive everything we need from you — delays in providing content, product information, or feedback will extend the delivery date accordingly. Timelines are estimates, not guarantees, though we work hard to hit them.

Our Satisfaction Guarantee

You review your finished site before it goes live, and we revise it until you're happy with it — your site does not launch until you approve it. This guarantee covers the design, content placement, and functionality we've agreed to build as part of your package. It does not cover requests that fall outside your original package scope (see Revisions & Scope), or issues caused by content, images, or product data you supply.

Revisions & Scope

Each package includes reasonable rounds of revision to get your site right within the scope of what you ordered. Requests that materially expand the original scope — additional pages, custom features, or a different platform than what was quoted — may be treated as a separate, additional-cost item. We'll always tell you before any extra work begins so there are no surprise charges.

Ownership

Once your final balance is paid, you own your website's design, content, and the store software configuration we've built for you — there is no ongoing platform rental fee for the site itself. Ecommerce Templates (ECT) is a third-party software product; your use of it is also subject to its own vendor license terms. We retain the right to display completed work in our own portfolio unless you request otherwise in writing.

Monthly Support Plan

The $75/month Support Plan is billed on a recurring basis through PayPal and covers the services described on our Monthly Support page. You may cancel at any time through your PayPal subscription settings; cancellation takes effect at the end of the current billing period, and we don't offer partial-month refunds.

Hosting & Third-Party Services

Where your project relies on third-party services — hosting providers, payment processors, shipping carriers, or the ECT cart platform itself — those providers' own terms, fees, and uptime apply. We are not responsible for outages, policy changes, or fees imposed by third-party providers outside our control.

Limitation of Liability

Our Services are provided on an "as is" basis. To the fullest extent permitted by law, our total liability for any claim relating to the Services is limited to the amount you paid us for the specific project or plan giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost sales or lost profits.

Changes to These Terms

We may update these terms as our Services evolve. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of our Services after a change means you accept the updated terms.
